Warranty is valid unless it is made in writing and
signedbyanauthorisedrepresentativeofOricom.
Oricomwillnotbeinbreachofawarrantyexpressly
setoutinthisUserGuideorundertheCompetition
andConsumerAct2010andexcludesanyliability
for damages or any other remedy arising under any
other legislation or the common law if the damage
occurs as a result of:
1.failurebyyoutoadheretothewarningsandfollow
the instructions set out in this user guide for the
proper installation and use of the product;
2.negligenceonyourpartormisusebyyouofthe
product;
3.anuncontrollableexternalcausewhichresultsin
theproductnotfunctioningincludingbutnotlimitedto
powerfailure,lightningorovervoltage;and
4.modicationtotheproductorservicescarriedout
ontheproductionbyanyoneotherthanOricomor
Oricom’sauthorisedserviceprovider.
Oricomwillnotbeliableforanydamagescausedby
theproductorthefailureoftheproducttoperform,
includinganylostprofitsorsavingsorspecial,
incidentalorconsequentialdamages.Oricomisnot
liableforanyclaimmadebyathirdpartyormade
byyouonbehalfofathirdparty.Thislimitationof
liabilityapplieswhetherdamagesaresought,ora
claimmade,underthisWarrantyorasatortclaim
(includingnegligenceandstrictproductliability),
acontractclaimoranyotherclaim.However,this
limitationofliabilitywillnotapplytoclaimsfor
personalinjury.NothinginthisWarrantyexcludes,
restrictsormodifiesanycondition,warranty,right
orremedywhichpursuanttotheCompetitionand
ConsumerAct2010appliestothisWarrantyand
whichmaynotbesoexcluded,restrictedormodied.
Forwarrantiesthatcannotbeexcluded,restricted
ormodied,Oricomlimitstheremediesavailableto
thosespeciedintherelevantlegislation.
